Terms and Conditions of Sale (T&Cs)
Article 1 – Purpose
These Terms and Conditions of Sale (hereinafter referred to as the “T&Cs”) govern the sale of products or services by ANDREA CUJAR (hereinafter referred to as “the Seller”) on the website www.andreacujar.com.
Article 2 – Acceptance of the T&Cs
The client declares having read and accepted these T&Cs without reservation before placing an order. By confirming their order, the client fully accepts the T&Cs.
Article 3 – Products and Services
The essential characteristics of the products and services offered are described and presented on the website as accurately as possible. However, should any errors or omissions occur in this presentation, the Seller shall not be held liable.
Article 4 – Prices
Prices for products are listed in euros, excluding VAT, in accordance with the VAT exemption applicable to micro-enterprises. Delivery charges are not included in the displayed price unless otherwise specified, and will be specified at the time of order confirmation. The Seller reserves the right to change prices at any time, but products will be invoiced based on the rates in effect at the time of the client’s order confirmation.
Article 5 – Orders
Any order placed on the ANDREA CUJAR website implies full and unreserved acceptance of these T&Cs. The client undertakes to provide accurate and complete information when placing an order. The Seller reserves the right to refuse or cancel an order if there are indications of fraud or malicious intent.
Article 6 – Payment
Payment for the order is made by the methods offered on the website (e.g. bank card, PayPal, etc.). Payment must be completed in full before the products are dispatched. If payment is not made, the order will be cancelled.
Article 7 – Delivery
Products are delivered to the address provided by the client when placing their order. The Seller undertakes to process orders as quickly as possible. Delivery times are provided for guidance only and may vary depending on the destination. In the event of a delivery delay, the client may cancel their order in accordance with Article L216-2 of the French Consumer Code and receive a refund.
Article 8 – Right of Withdrawal
In accordance with Article L221-18 of the French Consumer Code, the client has a 14-day withdrawal period from the receipt of the order to return the product to the Seller and receive a refund. The product must be returned in its original condition and with complete packaging. Return costs are borne by the client. For certain services or digital products, the withdrawal conditions may not apply.
Article 9 – Warranty
All products sold on the site are covered by the legal warranty of conformity and the legal warranty against hidden defects, in accordance with legal provisions. In the event of a defective or non-compliant product, the client must contact customer service at atelier@andreacujar.com to receive return or exchange instructions.
Article 10 – Liability
The Seller shall not be held liable for any damage arising from improper use of the products sold, negligence by the client, or events of force majeure. The Seller’s liability is limited to direct and foreseeable damages.
Article 11 – Personal Data Protection
Personal data collected when placing an order is necessary for managing orders and improving services. In accordance with the GDPR, the client has the right to access, modify, correct, and delete their data by contacting customer service at atelier@andreacujar.com. Data is retained for the necessary duration of processing.
Article 12 – Intellectual Property
All elements of the site (texts, images, logos, etc.) are the exclusive property of the Seller. Any reproduction, exploitation, or use for commercial purposes is prohibited without prior authorisation.
Article 13 – Applicable Law and Dispute Resolution
These T&Cs are governed by French law. In the event of a dispute, the client is invited to contact customer service to attempt an amicable resolution. Failing amicable resolution, the dispute will be subject to the exclusive jurisdiction of French courts.
